2. Description of Services

Cinematique provides access to:

  • CineStudio: software for creating, editing, or generating micro-dramas and audiovisual content using AI-assisted tools and actor performance processing.

  • CineShorts: a future streaming platform intended for the distribution of micro-dramas.

  • Early access programs, waitlists, promotional tools, or beta features.

We reserve the right to modify, update, or discontinue any part of the service at any time.

3. Eligibility

You must be at least 16 years old to use the Services. If you are under 18, you represent that you have permission from a parent or legal guardian.

If you create an account, you must provide accurate and complete information.

4. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

We may suspend or terminate your account if:

  • you violate these Terms

  • your activities pose a risk to the platform

  • you misuse AI tools or generate prohibited content

5. Intellectual Property Rights

All software, logos, designs, text, graphics, videos, and content made available through Cinematique belong to Cinematique or its licensors.

You agree not to:

  • use the services to create competing products

  • remove or bypass copyright protections

Your Content

By uploading, submitting, or generating content through our services, you grant Cinematique a worldwide, non-exclusive, royalty-free license to host, display, and process your content for the operation of the platform.

You retain full ownership of your original content unless a separate agreement states otherwise.

6. AI-Generated Content

Our tools may generate or transform images, videos, scripts, or audiovisual works using artificial intelligence.

You acknowledge that:

  • AI outputs may be imperfect or contain errors

  • AI outputs may resemble existing works unintentionally

  • You are solely responsible for ensuring your use complies with laws, including copyright and personality rights

Cinematique does not guarantee any specific result or performance from AI-generated content.

7. Prohibited Uses

You agree not to use the Services to create, upload, or distribute:

  • illegal, defamatory, or hateful content

  • deepfakes of real individuals without consent

  • explicit or violent material

  • content that infringes on third-party rights

  • content intended for political manipulation or misinformation

Failure to comply may result in account suspension or legal action.

8. Payments and Subscriptions

If you subscribe to paid features:

  • prices are displayed in euros (€)

  • subscriptions renew automatically unless cancelled

  • taxes may apply based on your location

You may cancel at any time, but fees already paid are non-refundable except where required by law.

9. Waitlist and Early Access

By joining our waitlist or early access program, you acknowledge that:

  • access is not guaranteed

  • features may change, break, or be removed

  • promotional credits, if offered, have no monetary value

  • beta features may contain bugs

10. Third-Party Services

Our services may integrate or rely on third-party tools (e.g., AI models, cloud storage, payment providers).
We are not responsible for the availability or performance of third-party services.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Cinematique is not liable for indirect, incidental, or consequential damages

  • total liability is limited to the amounts you have paid in the previous 12 months (if any)

We do not guarantee uninterrupted access, error-free operation, or specific performance results.

12. Indemnification

You agree to indemnify and hold Cinematique harmless from any claims arising from:

  • your content

  • your misuse of the services

  • your violation of these Terms or applicable laws
